 The following “Terms and Conditions” is set to govern the use of and purchase of products and services from Sapa Travel website – www.sapatravel.com – (hereinafter referred to as Site, We, Us, Our). This is subject to change without notice to be suitable with local regulations and laws at the temporary time. Accordingly, we highly recommend you to check it to update our information regularly.

You agree to use the Site for lawful purposes. If you plan to or are committing any deeds that may hamper or affect the performance of the website, or transmit contents that are harmful, abusive, vulgar, discriminative, hateful, you must leave immediately.

1. Privacy Policy:
We respect and are committed to protecting the privacy of our website visitors. By using this website and/or purchasing the services offered on our website, you agree that you have read and accepted the following conditions of our privacy statement.

a – Collection of information: We will collect, store and use the following kinds of personal data: information that is required to complete your tour booking such as your name, date of birth and date of arrival in Vietnam. Your contact information such as email and phone will also be collected if you choose to proceed with the booking or decide to sign up for our newsletter.

b – Use of information: Personal data submitted on this website will be used to reserve portions of the tour such as air ticket, train ticket, hotel rooms and other services where necessary. We use your contact information only when it becomes important for us to contact you regarding our Site, new services and promotions which we think you will find relevant and valuable. If you would like to stop this service, you can choose to unsubscribe from our newsletter by emailing us: info@sapatravel.com

c – Link to third party websites: This site contains link to third party website and we are not responsible for the privacy policy or contents of such website.

d – Cookies: Our site enables the use of cookies and use this information to help diagnose problems with our server and administer our site. We also gather broad demographic information to help us improve our website quality and performance.

e – Policy amendments:  We reserve the rights to update or amend this privacy policy anytime by posting a new version on our website. You should check this page occasionally to ensure you are aware of these changes.    

f – Updating information:  Please let us know if the personal information which we hold about you needs to be corrected or updated. Changing of names on visa document, train tickets or flight tickets can be time consuming and costly so we suggest you to contact us immediately after spotting any inaccuracy. 

2. Security:
We use the highest possible security measures to protect your information and the use of our website. These include Norton Secured and McAfee Secure and they are updated on a regular basis to optimize the safety and security of this site.

3. Copyright:
Unless otherwise stated, all materials appearing on this Site are copyrights and trademarks owned by SAPA TRAVEL. No right, title or interest in any downloaded materials will be transferred to you nor is any web user allowed to reproduce, publish, distribute, display, exploit in any way for commercial purpose.

4. The Contract:
A contract will be signed once you proceed successfully with our booking procedure including accepting our itinerary or proposal, and paying the deposit.

We reserve the right to terminate the contract in case:
– Customer’s behavior, manner or action cause offence to our company, our site or other partners.
– Unpredicted conditions of weather, natural disasters and spreading diseases take place in the area that you plan to visit. In this case, we will contact you for further information.

5. Payment:
To ensure that both parties will fulfill their obligations, we propose some detailed conditions for payment as follows:

a – Service fee:

All payments are subject to a 3.5% processing fee. In an effort to keep the price down for clients, we offer fee waiver for your deposit payment. The remaining balance shall be settled when you arrive in Hanoi and if you decide to settle the balance by credit card, the service fee 3.5% fee will be added to the balance with amount equal to or larger than $300.

If the balance payment is less than $300 we will waive this fee for you.

b- Deposit: Either full payment or a deposit of 30-50% of total cost will be required and decided on individual tour basis. This should be done via one of our payment methods available online. Customer will receive confirmation documents or vouchers within 24 hours from the time we receive the deposit.

We do NOT charge processing fee for deposit payment.

c – Final Payment: Full payment should be made at least 2 days prior to your arrival in Vietnam. Payment on arrival is applied for special cases only and both parties have written agreement on this.

Payment by credit card may be subject to 3.5% processing fee.

d – Cancellation and refunds: 

Cancellation fees of booking are levied on all local suppliers as cruise carriers and other contractors apply their own cancellation policy. Cancellation and refund policies are detailed on each individual cruise, under the Rate & Availability tab.

Cancellation by the cruise for reasons related to a situation of force majeure, such as government restriction or regulation, health, natural disasters, acts of God, etc., customers will be refunded the amount depending to circumstances. If the tour has yet to take place, full refund will be made. If the tour is ongoing, partial refund will be made.

No refunds or exchanges can be made while the tour in ongoing and the customer decides to opt out. If you do not use any of the service, no compensation will be given for the unused portion of the tour.

6. Alternatives:
Whilst we manage to reserve all the proposed services for our clients, we reserves the right to make changes of equivelant services in case transportation/ accommodation is fully booked. In this case, we always try our best to inform you about the changes as soon as possible.  

If we are unable to provide confirmed services, an alternative service or an alternative departure date will be offered subject to availability. If this alternative date or the alternative service is not acceptable to our clients will be refunded.

7. Shuttle bus service:
Unless otherwise stated, all shuttle bus service are operated by the cruise companies. The pick up point is limitted to hotels in the Old Quarter only with few exceptions made by the cruise. If you are leaving from the airport or train station or staying in a hotel outside of Hanoi Old Quarter, you are responsible for arranging your own transfer to our office at 35-37 Hang Quat or 3B Bao Khanh Lane, Hang Trong, Hoan Kiem, Hanoi to be picked up by shuttle bus.

8. Visa approval letter service:
As a travel agent, we offer you complimentary visa approval letter service when you book our tour. Please note that you are responsible for paying stamping fee and preparing all necessary documents required for the entry procedure at Vietnam Airport. You are also responsible for providing us the required information at least 05 days prior to your arrival date in order for us to process the letter in a timely manner.

We are not to be held responsible for any delay or entry denial which are solely at the discretion of Vietnam’s Immigration Department.

9. Use of day boat for 3 day 2 night trip:
(a) Except for charter cruise or a limitted number of cruises such as Dragon Pearl, Dragon Legend, all other cruises use a day boat for activities on the second day of the trip. During this day you may not have any acess to the mother boat and your cabin until mid-afternoon. 

(b) Unless otherwise stated, all cruises listed on our website use the same vessel for both 2 day and 3 day guests as it is a common practice for cruises in Halong Bay.

We are not to be held responsible for this change of boat as mentioned in (a) or the use of boat (b) which are both organized by the cruise operator.

10. Arrangment of cabin:
All cabins arrangment are at complete disposal by cruise operator. We are not to be held responsible for any purposive arrangement of your cabin. If you have any special request (such as cabins on the same level, next to each other, non-smoking, etc) please email us at time of booking.

11. Disclaimers:
From time to time there may be information on our site that contains typographical errors, inaccuracies, or omissions about product descriptions, pricing, and availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice.
